Terms of Service

These Terms of Service are a contract between you and BisonFlex (we, us, our). By using this website or buying our products you agree to them. If you do not agree, do not use the site or place an order.

You must be 18 or older to place an order, or use the site with the involvement of a parent or legal guardian who agrees to these terms.

Our mixes are food. They are made with milk, egg, and tree nut (almond) ingredients. Always read the ingredient list and allergen statement on the pouch and on the product page before you buy and before you eat, because recipes and formulations can change. If you have a food allergy or sensitivity, rely on the label on the bag in your hands, and do not consume the product if it conflicts with your needs.

Nutrition information on this site describes the product as sold and prepared per the directions. Nothing on this site is medical or dietary advice. Talk to your doctor or a registered dietitian about how any food fits your diet, allergies, or medical conditions.

Checkout and payment run on Shopify. Your order is an offer to buy. We accept it when we send your shipping confirmation. We may cancel an order before shipment for suspected fraud, a pricing or listing error, or an out-of-stock product, and if we cancel we will tell you and promptly refund everything you paid. All prices are in US dollars.

Subscribe & save is an automatically renewing subscription. When you choose it, you authorize us (through Shopify) to charge the payment method you provide for the pouches in your subscription at the subscription price shown at checkout, plus any shipping and tax, when you place the order and then again on each renewal date, on the schedule shown at checkout (for example every 4 weeks), until you cancel.

The subscription price is the plan discount off the regular pouch price. It does not combine with the 3 and 6 pouch pack discounts. Free shipping on orders of 6 or more pouches applies to each delivery that qualifies; otherwise the carrier rate selected at checkout applies to each delivery. If we change the regular price or the plan discount, we will email you before the change applies to your subscription, and you can cancel before the next renewal if you do not agree.

You can skip a delivery, pause, change the payment method or shipping address, or cancel at any time, with no fee, from the Subscriptions link in your account on this site, which opens Shopify's subscription page and signs you in with a code sent to your email. You can also cancel by emailing support@bisonflex.org from the email address on the order. A cancellation takes effect for renewals that have not yet been charged; an order already charged ships as normal and is covered by our Refund Policy.

Shopify emails you a reminder 3 days before each renewal is charged, so you can skip, pause or cancel first. If a renewal payment fails, Shopify will retry it and email you to update the payment method; if it still fails, the subscription is paused or cancelled and nothing further is charged. Subscription orders earn points and may use a reward code on the first delivery only, and are otherwise subject to these terms like any other order.

We may change prices, packaging, and product specifications, or retire a product, at any time. Changes never apply retroactively to an order we have already accepted.

First-order code. New customers who join our email list receive a one-time code for 10% off the mixes on a first one-time order. One code per email address and per person, valid for 30 days from sign-up, not valid on subscriptions, and not combinable with the pack deals, Herd rewards, or any other discount; checkout applies whichever single discount is larger. The code has no cash value and is void if an order is cancelled or refunded. We may withdraw or change the offer for future sign-ups at any time; a code already issued keeps its stated terms until it expires.

We currently ship within the United States only. Orders leave our warehouse within 1 to 2 business days. Delivery dates shown by carriers are estimates, not guarantees.

If we cannot ship within the time we stated, or within 30 days if no time was stated, we will notify you with a revised shipping date and offer you the choice to accept the delay or cancel for a full and prompt refund. If you do not consent to a delay, or we cannot give you a definite revised date and you do not agree to wait, we will cancel the order and refund you promptly, consistent with the FTC Mail, Internet, or Telephone Order Rule. If a shipment is lost or shows no movement, email support@bisonflex.org and we will chase the carrier, and replace or refund the order when it is confirmed lost.

Returns and refunds are governed by our Refund Policy page, which is part of these terms. The short version: unopened bags within 30 days of delivery, opened bags cannot come back because they are food, and damaged or wrong orders are replaced or refunded when you report them within 7 days with a photo.

You agree to use the site only for lawful purposes, and not to probe, disrupt, scrape at scale, or misrepresent yourself. The chat on this site gives automated answers about our products. It is a convenience, not a substitute for the label on the product or for professional advice.

The BisonFlex name, logo, photography, recipes as written, and all site content belong to BisonFlex and are protected by copyright and trademark law. You may not use them commercially without our written permission. Cooking from our recipes at home is exactly what they are for.

Checkout is provided by Shopify under its own terms and privacy policy, which apply to the checkout process alongside ours. We are not responsible for third-party services we do not control.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY LAW, THE SITE AND OUR PRODUCTS ARE PROVIDED AS IS, AND WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

Nothing in this section limits warranties or rights that consumer law does not allow to be limited. Some states do not allow limits on implied warranties, so parts of the paragraph above may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, BISONFLEX WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, AND OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT OR ORDER THAT GAVE RISE TO THE CLAIM.

Some states do not allow these limits, so they may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including for gross negligence or willful misconduct.

You agree to cover losses we suffer because you violated these terms or misused the site, to the extent caused by your violation or misuse.

These terms are governed by the laws of the State of Florida, without regard to conflict of law rules.

If something goes wrong, email support@bisonflex.org first. Most problems are fixed in one reply. If we cannot resolve a dispute informally within 30 days, you and BisonFlex agree to resolve it through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis. Either side may instead bring an individual claim in small claims court.

YOU AND BISONFLEX EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION. You may opt out of this arbitration section by emailing support@bisonflex.org within 30 days of your first order, with your name and order number, stating that you opt out of arbitration.

We may update these terms. The date at the top reflects the latest version, and changes apply from posting forward. Continuing to use the site after a change means you accept the new terms.
